Terms & Conditions
1. General:
1.1. These terms and conditions, together with the Narellan Pools privacy policy which is incorporated by reference into these terms and conditions (and is available at www. https://narellanpools.com.au/privacy-policy/) contain the entire understanding and agreement between Narellan Pools Pty Ltd of Suites 403-410, Level 4, 4 Columbia Court, Baulkham Hills NSW 2153 (the Promoter) and clients of the promotion (each a Participant) in relation to the Narellan Pools “$2,000 Off Your Pool” Show Special Promotion (the Promotion).
1.2. By participating in the Promotion, the participant is deemed to have accepted these Terms and the Narellan Pools Privacy Policy.
1.3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
2. Promotion Date:
2.1. The promotion periods are as follows:
2.1.1. For orders placed after the client attended the SPASA show in Victoria, the promotional period commences at 9:00am on 2 February 2024 and expires at 5:00pm on 4 April 2024;
2.1.2. For orders placed after the client attended the SPASA show in New South Wales, the promotional period commences at 9:00am on 2 March 2024 and expires at 5:00pm on 3 May 2024;
2.1.3. For orders placed after the client attended the SPASA show in South Australia, the promotional period commences at 9:00am on 23 March 2024 and expires at 5:00pm on 24 May 2024;
2.1.4. For orders placed after the client attended the SPASA show in Queensland, the promotional period commences at 9:00am on 18 May 2024 and expires at 5:00pm on 19 July 2024.

2.2. In the event that a SPASA show is rescheduled, these terms and conditions will be updated to reflect the dates of the rescheduled show.
2.3. All times noted in these terms and conditions are local times, based on the location of the Promoter.
3. Promotion Details:
3.1. The Promotion offers each new client who satisfies the eligibility criteria a discount of $2,000 (incl GST) off their Narellan Pools contract.
3.2. This offer is not to be used in conjunction with any other offer, promotion or discount by the Promoter and is not transferable or redeemable for cash.
4. Eligibility:
4.1. In order to receive the Promotion, participants must:
4.1.1 attend the Narellan Pools stand at a SPASA show; and
4.1.2. provide their contact details to a Narellan Pools representative to enter into the Narellan Pools CRM at the SPASA show; and
4.1.3. enter into a contract to install a Narellan Pools pool with a Narellan Pools local pool builder within two months of the SPASA show.
4.2. A “participant” refers to anyone who has not yet entered into a contract (or paid a deposit) for a Narellan Pools pool.
4.3. A participant will be excluded from this promotion if their contact details are not located in the Narellan Pools CRM.
4.4. Participants must purchase new pools only. The purchase of blemish pools, kit pools or spas are not eligible for this promotion.
4.5. Employees of the Promoter, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each, are not eligible to participate in the Promotion. Immediate family members include any of the following: spouse, de-facto spouse, child, step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
4.6. Narellan Pools accepts no liability in the event that it does not attend a SPASA show.
4.7. Only one entry per household will be permitted.
4.8 The Promotion is subject to all applicable laws and regulations of Australia.
5. Privacy:
5.1. By entering into this promotion, participants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
5.2. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged to conduct the competition draw and for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions.
5.3. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at https:/narellanpools.com.au/privacy-policy. You may request access or to update your personal information or lodge a complaint by writing to The Privacy Officer, Narellan Pools Pty Limited (ABN 44 003 607 681) of Suite 403-410, Level 4, 4 Columbia Court, Baulkham Hills, NSW 2153.
6. General:
6.1. The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion or if such a change is required to ensure the safety of the Promoter, its representatives and of entrants. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this promotion.
6.2. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
6.3. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees‘).
6.4. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any tax liability incurred by a winner or Participant; or (d) any failure by the Promotor to attend any SPASA show.
