Terms and Conditions
1. General
(a) These terms and conditions, together with the Narellan Pools privacy policy which is incorporated by reference into these terms and conditions (and is available at www. https://narellanpools.com.au/privacy-policy/) contain the entire understanding and agreement between Narellan Pools Pty Ltd of Suites 403-410, Level 4, 4 Columbia Court, Norwest, NSW 2153 (the Promoter) and clients of the promotion (each a Participant) in relation to the Narellan Pools Fluidra ECOlite Offer (the Promotion).
(b) By participating in the Promotion, the Participant is deemed to have accepted these Terms and the Narellan Pools Privacy Policy.
(c) To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
2. Promotion Period:
(a) The Promotion commences at 9:00am on Thursday, 5 February 2026 and expires at 5:00pm on Friday, 6 March 2026 (the Promotional Period).
(b) All times noted in these terms and conditions are local times, based on the location of the Promoter.
3. Promotion details:
(a) For the first three hundred and twenty (320) eligible Participants, the Promotion offers a free ECOlite IHP120 heat pump (RRP $3,989.00) and installation (valued at $2,100.00, excluding electrical installation).
(b) An eligible “Participant” must meet the following criteria during the Promotional Period:
(i) reside in either New South Wales or the Australian Capital Territory, Australia;
(ii) enter into a contract to install a Narellan Pools pool with a Narellan Pools local pool builder in the area described above in clause 3(b)(i) and have their pool installed before 31 December 2026; and
(iii) purchase the following Fluidra products for their Narellan Pools pool from the Promoter or a Narellan Pools local pool builder in the area described above in clause 3(b)(i):
(A.) pump;
(B.) filter;
(C.) Halo chlorinator;
(D.) 2 x lights; and
(E.) Halo Lite controller.
(c) Participants must purchase full priced new pools only, including special builds. The purchase of blemish pools, kit pools or spas are not eligible for this Promotion.
(d) Participants acknowledge that the ECOlite IHP120 heat pump may not be suitable for all pools. Participants who upgrade from the ECOlite IHP120 heat pump to another Fluidra heat pump, are entitled to receive a discount of $3,989.00 off the RRP and agree to pay the remaining balance.
(e) This offer is not to be used in conjunction with any other offer, promotion or discount and is not transferable or redeemable for cash.
(f) To the extent of any inconsistency between these Terms and Conditions and any other reference to this promotion, these Terms and Conditions prevail.
(g) Employees of the Promoter, their respective affiliates, subsidiaries, franchisees, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each, are not eligible to participate in the Promotion. Immediate family members include any of the following: spouse, de-facto spouse, child, step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
(h) Only one offer per household will be permitted.
(i) The Promotion is subject to all applicable laws and regulations of Australia.
4. Privacy:
(a) By entering into this Promotion, participants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
(b) The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this Promotion.
(c) The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at https:/narellanpools.com.au/privacy-policy. You may request access or to update your personal information or lodge a complaint by writing to The Privacy Officer, Narellan Pools Pty Limited (ABN 44 003 607 681) of Suite 403-410, Level 4, 4 Columbia Court, Norwest, NSW 2153.
5. General:
(a) The Promoter (subject to both New South Wales and Australian Capital Territory legislation) reserves the right to amend, cancel or suspend this Promotion if an event beyond the control of the Promoter corrupts or affects the administration security, integrity or proper conduct of this Promotion or if such a change is required to ensure the safety of the Promoter, its representatives and of Participants.
(b) Any cost associated with accessing the Promoter’s website is the Participant’s responsibility and is dependent on the Internet service provider used.
(c) Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in New South Wales and the Australian Capital Territory, Australia (‘Non-Excludable Guarantees‘).
(d) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any tax liability incurred by a winner or Participant.
